Please read these Terms of Service (“Terms”) carefully before using the website or services offered by Restora Functional Health LLC (“we,” “us,” “our,” or “Restora”). By booking a consultation, purchasing a coaching package, using our website, or otherwise engaging our services (collectively, the “Services”), you (“you,” “client,” or “your”) agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Who We Are and Scope of Services
Restora Functional Health LLC provides functional health coaching services focused on digestive health. Our practitioner may be referred to as a “Functional Health Practitioner” specializing in digestive health — this title describes a professional identity and area of specialization, not a professional license, medical degree, or clinical credential. Additional degrees, certifications, or credentials referenced on our website or elsewhere (including but not limited to PhD, MBA, FDN-P, CHNP, or board certification through the American Association of Drugless Practitioners) reflect academic and private-certification achievements and do not constitute a license to practice medicine or healthcare in Colorado or any other state.
Restora Functional Health LLC is not a medical practice. We do not diagnose, treat, cure, or prevent any disease or medical condition, and we are not a substitute for care from a physician or other licensed healthcare provider. We are not a HIPAA “covered entity” or “business associate,” as we do not provide clinical healthcare services or bill insurance.
Our Services consist of educational coaching, lifestyle and nutritional guidance, accountability support, and interpretation of functional lab testing to help you pursue your personal health goals. Please see our Disclaimer for additional detail on the scope of our services.
2. No Medical Advice; Not for Emergencies
Nothing provided through our Services — including consultations, protocols, lab result interpretations, written materials, or communications — constitutes medical advice, diagnosis, or treatment. You should always seek the advice of a physician or other qualified healthcare provider with any questions you may have regarding a medical condition, and you should never disregard professional medical advice or delay seeking it because of something you learned through our Services.
Our Services are not appropriate for medical emergencies. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately. Do not rely on Restora Functional Health LLC, its practitioners, or its communications channels for emergency response.
If you are pregnant, nursing, managing a diagnosed medical condition, or taking prescription medication, you should consult your physician before beginning any coaching program, dietary change, or supplement protocol recommended through our Services.
3. Eligibility
Our Services are intended for individuals who are at least 18 years of age. By using our Services, you represent that you are at least 18 years old and legally able to enter into a binding contract. Our Services are not directed to, and are not intended for use by, anyone under the age of 18.
4. Client Responsibilities
By using our Services, you agree that you will:
- Provide accurate, current, and complete information during intake, consultations, and throughout the coaching relationship
- Promptly inform us of any changes to your health status, medications, or medical care that may be relevant to your coaching program
- Consult with a licensed physician or other qualified healthcare provider regarding any medical questions, diagnoses, or treatment decisions
- Use good judgment and discontinue any recommendation that causes discomfort or an adverse reaction, and seek appropriate medical care if needed
- Take full personal responsibility for decisions you make regarding your health, including decisions to follow, modify, or disregard any recommendation made through our Services
5. Fees, Payment, and Cancellation
Fees. Fees for coaching packages, consultations, and related services are as quoted at the time of booking or purchase. All fees are due as outlined in your specific service agreement or invoice.
Payment processing. Payments are processed securely through third-party payment processors. We do not store full payment card numbers on our own systems.
Cancellations and rescheduling. We ask that you provide at least 24 hours’ notice to reschedule or cancel a scheduled appointment. Late cancellations or missed appointments may be subject to a fee, as described in your service agreement.
Refunds. Coaching packages and services are generally non-refundable once services have commenced, except as otherwise stated in your specific service agreement or as required by applicable law. Any lab testing or supplement costs paid directly to Fullscript are governed by Fullscript’s own refund and return policies.
6. Lab Testing and Supplements (Fullscript)
We use Fullscript exclusively to recommend and facilitate lab testing and supplements. Please review our Privacy Policy for details on how your information is handled in connection with Fullscript.
By choosing to pursue lab testing or supplements recommended through Fullscript, you acknowledge and agree that:
- You will create your own account directly with Fullscript, and your purchase is a separate transaction between you and Fullscript, subject to Fullscript’s own terms of service
- Lab testing and supplement costs are your responsibility and are generally non-refundable once ordered, subject to Fullscript’s policies
- Because we are not licensed physicians, certain lab orders are reviewed and authorized by a licensed clinician through Fullscript’s Authorization Network before being processed
- Our review and interpretation of your lab results, and any resulting protocol, is provided as educational coaching guidance and is not a medical diagnosis or treatment plan
- You are solely responsible for reviewing and following any preparation instructions (such as fasting requirements) provided by Fullscript or the testing laboratory
7. Assumption of Risk and Release of Liability
You understand and agree that participation in health coaching, including any dietary, lifestyle, or supplement recommendations, involves inherent risks, including the possibility of allergic reaction, interaction with medication, or other adverse effects. You voluntarily assume all risks associated with your participation in our Services.
To the fullest extent permitted by applicable law, you release, waive, and discharge Restora Functional Health LLC, its owner, employees, and contractors from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury that may be sustained by you as a result of participating in our Services, except to the extent such loss, damage, or injury is caused by our gross negligence or willful misconduct.
8. No Guarantee of Results
Health coaching outcomes vary significantly from person to person based on individual circumstances, adherence, underlying health conditions, and many factors outside our control. We make no guarantees, warranties, or promises — express or implied — regarding specific results, symptom improvement, or health outcomes from our Services. Any testimonials, case studies, or examples shared on our website or elsewhere reflect individual experiences and are not a guarantee that you will achieve similar results.
9. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Restora Functional Health LLC, its owner, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of our Services, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or our Services shall not exceed the total amount you paid to us for the specific service giving rise to the claim in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Restora Functional Health LLC, its owner, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of our Services, your violation of these Terms, or your violation of any rights of a third party.
11. Confidentiality and Privacy
We handle your personal and health information in accordance with our Privacy Policy, which is incorporated into these Terms by reference. We ask that you likewise respect the confidentiality of any group coaching sessions, shared resources, or other participants you may interact with through our Services.
12. Intellectual Property
All content provided through our Services — including protocols, written materials, website content, graphics, and educational resources — is the property of Restora Functional Health LLC or its licensors and is protected by copyright and other intellectual property laws. You may use these materials for your own personal, non-commercial purposes only. You may not reproduce, distribute, publicly display, or create derivative works from our materials without our prior written consent.
13. Termination
We reserve the right to discontinue coaching services to any client at our discretion, including if we believe continuing the relationship would not be in the client’s best interest, if a client engages in abusive or inappropriate conduct, or if a client fails to make required payments. You may discontinue services at any time, subject to the cancellation and refund terms in Section 5.
Sections of these Terms that by their nature should survive termination (including but not limited to Sections 7 through 12) will survive any termination of the coaching relationship.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles, regardless of your state or country of residence.
Informal resolution first. If a dispute arises, we encourage you to first contact us directly using the information in Section 17 so we can attempt to resolve the issue informally.
Venue. If informal resolution is not successful, any dispute arising out of or relating to these Terms or our Services shall be brought exclusively in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of such courts.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, services, or legal requirements. We will post any changes on this page and update the “Last Updated” date above. Your continued use of our Services after any changes constitutes your acceptance of the revised Terms.
16. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy and any specific service agreement you enter into with us, constitute the entire agreement between you and Restora Functional Health LLC regarding your use of our Services, and supersede any prior agreements or understandings.
